All prints, images and artwork or the like sold by EMILYROSEDESIGNSLTD remain the intellectual property rights of EMILYROSEDESIGNS and Emily Rose Nathanail. Therefore, no prints, images or photography may be reproduced or duplicated without the express written permission of Emily Rose Designs or Emily Rose Nathanail.
Any breach of the above will be acknowledge as a violation to the Terms and Conditions and will be prosecuted under copyright infringement underwritten by UK and International law.
By using the website, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password. We reserve the right to refuse service, terminate accounts, remove or edit content, or cancel orders in our sole discretion.

We will not be liable for any damages of any kind arising from the use of the website, including, but not limited to direct, indirect, incidental, punitive or consequential damages.
These Terms of Sale apply to all offers made by Emily Rose Designs; all purchases and orders placed by you and all agreements concluded between us in relation to the products and services offered on this website.
All delivery times from online shop will vary per order type, location and subject to timeline. ERD will provide timeframes directly to client dependant on project specificity.
No refunds will be made available for any bespoke items (i.e. items and services that have been custom made bearing any/or client specific details. Refunds will ONLY be made on general items (generic and unedited prints, posters, cards etc.) if returned in unused and boxed condition.
The buyer is responsible for return shipping. Refunds will only be made of original purchase price and will not include shipping. The buyer has 14 days from purchase to complete return. If the goods are received by ERD later than 14 days from purchase ERD is not tied to refund and has the right to cancel said refund. If at any point the goods are deemed as damaged, used or unsuitable for resale by ERD; refund can be cancelled. Shipping charges will not be refunded. Items damaged in shipping return will not be refunded but returned to Customer.
ERD is not responsible for any damage due to shipping or outside of ERD's control. Tracking and delivery assurances are the sole responsibility of the client once shipment has been made from ERD, non-delivery due to client error/client absence solely lies upon the client and is not the responsibility of ERD. ERD makes all efforts to provide client with tracking details and ensures that items are properly packaged. At the time of shipping.
We attempt to describe our products offered as accurately as possible. However, we do not warrant that product descriptions or other content of the website are 100% accurate, complete, reliable, current or error-free. If a product offered by us and purchased by you is not as described, your sole remedy is to return it in unused condition for a conforming replacement or refund.
Any disputes or legal matters shall be arbitrated or tried under UK law.
If any of the terms or conditions herein shall be deemed invalid, void, or for any reason unenforceable, that term or condition shall be deemed severable and shall not affect the validity and enforceability of any remaining term or condition.
Clients are solely responsible and thus indemnify ERD from all grammar and spelling as signed off by client, albeit incorrect, at proof stage. All copy will be provided by the client and added to the design by ERD. Once signed off by the client no further amendments or changes can be made. If any changes are requested post sign off, this will be treated as and considered a new project.
All copy will be provided by the client for any artwork and will be copied verbatim (i.e. word for word). The artwork will replicate this information exactly. ERD accepts no liability for spell check, this needs to be checked by the client.
All intellectual property remains solely owned by Emily Rose Designs Ltd. Whilst it is with ERD encouragement that the artwork is shared and given credit where due, Emily Rose Designs holds all copyright © Therefore ERD holds the right to share the artwork after the 'Event Date'. Personal details including phone numbers, emails and home addresses will be altered or amended prior to sharing. If the client has a specific request, they can reach out to ERD in advance of signing their personalised agreement.
